Can police access deleted messages on mobile?

I have a Microsoft Lumia mobile phone, and I am actually doing a school project on what police can do now in 2015, so can police retrieve deleted messages, my main focus is domestic violence cases, so if a woman accused her husband of domestic violence would the police access her deleted messages? If she did allow it? ND what would happen if she didn't allow it?
